Terms of Service

1. Acceptance & Eligibility

You must be at least 18 years of age and have the legal authority to enter into binding contracts in your jurisdiction to use this Platform. By creating an account or making a booking, you represent and warrant that you meet these requirements.

If you are using the Platform on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms, and "you" refers to both you and that entity.

2. User Accounts

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password confidential and not share it with others
• Be solely responsible for all activity that occurs under your account
• Notify us immediately at support@letsgosave.com of any unauthorized use of your account

We reserve the right to suspend or permanently terminate your account if we determine, in our sole discretion, that you have violated these Terms, engaged in fraudulent activity, or engaged in conduct harmful to other users, travel suppliers, or LetsGoSave.

3. Platform Use & Restrictions

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Make false, fraudulent, speculative, or unauthorized bookings
• Use the Platform via automated tools, bots, scrapers, or data mining software without our written permission
• Attempt to bypass, disable, or circumvent security features or access controls
• Access another user's account or impersonate any person or entity
• Engage in any conduct that could damage, disable, overburden, or impair our servers or networks
• Copy, reproduce, distribute, or create derivative works from our content without permission
• Post or transmit any content that is unlawful, defamatory, obscene, or otherwise objectionable
• Resell, sublicense, or commercialize access to the Platform without our written consent

4. Travel Bookings

LetsGoSave acts as an intermediary between you and travel suppliers (hotels, airlines, car rental companies, etc.). When you make a booking through our Platform:

• Supplier Contracts: Your booking constitutes a contract directly between you and the travel supplier. The supplier's own terms and conditions, including cancellation and refund policies, govern that contract. You agree to comply with those terms.
• Booking Confirmation: You will receive a confirmation email with your booking details. This email is your receipt. Review it immediately and contact us within 24 hours if you notice any errors.
• Accuracy of Information: You are responsible for ensuring that all traveler names, travel dates, and other booking details are accurate. Name corrections may not be possible after booking, and misspelled names may result in denied boarding by airlines.
• Pricing: Prices are subject to availability and may change at any time before you complete a booking. Once your booking is confirmed and payment processed, the price is locked. We reserve the right to correct obvious pricing errors.
• Travel Documents: You are responsible for ensuring you have valid passports, visas, and any required health documentation. LetsGoSave is not responsible for denied entry or travel disruptions due to missing documentation.

5. Payments & Pricing

• All prices are displayed in USD unless otherwise noted and include applicable taxes and fees.
• By providing payment information, you authorize LetsGoSave to charge your payment method for the total amount of your booking.
• Payments are processed via Stripe, a PCI DSS-certified payment processor. We do not store full credit card numbers.
• If a payment fails, we may cancel your booking and you will be notified immediately.
• Chargebacks: If you initiate a chargeback without first contacting us to resolve the issue, we reserve the right to suspend your account and pursue recovery of the disputed amount.

6. Cancellations & Refunds

• Cancellation and modification policies vary by travel supplier and are disclosed during the booking process and in your confirmation email.
• Refundable bookings may be cancelled for a full refund before the supplier's stated deadline. Non-refundable bookings are not eligible for refunds unless the supplier makes an exception.
• To cancel a booking, log into your account and navigate to "My Bookings," or contact our support team at support@letsgosave.com.
• Refunds, when applicable, are processed within 5–10 business days to your original payment method, subject to your card issuer's processing time.
• LetsGoSave is not responsible for supplier-initiated cancellations, modifications, or disruptions (e.g., hotel overbooking, airline cancellations). In such cases, we will assist you in resolving the issue with the supplier.

7. Goody Points Program

• Earning Points: Goody Points are earned on eligible bookings completed through the Platform. The points rate is displayed at the time of booking. Points are credited to your account approximately 30 days after your travel date to account for potential cancellations.
• Donation to Nonprofits: You may donate your Goody Points to registered nonprofit organizations listed on our Platform. Donations are final and non-reversible.
• Redemption: Points can be redeemed for future travel credits, products in our Rewards Store, or cash payouts (subject to wallet activation and identity verification).
• Cash Payouts: To request a cash payout, you must activate your Goody Wallet and complete identity verification. Payout eligibility is subject to a 30-day waiting period between payouts. The conversion rate between points and dollars is set by LetsGoSave and may change with notice.
• Expiration: Points expire after 24 months of account inactivity. "Activity" means any booking, redemption, or donation made through the Platform.
• No Cash Value: Points have no independent cash value outside of our defined redemption options and cannot be transferred between accounts.
• Program Modifications: We reserve the right to modify point values, redemption rates, expiration policies, eligible activities, and other program terms at any time with reasonable notice. We will not retroactively remove points already earned without 30 days' prior notice.

8. Corporate Accounts

Corporate accounts allow businesses to manage employee travel bookings under a single billing relationship. Corporate account administrators are responsible for:

• Ensuring all users added to the corporate account agree to these Terms
• Managing access and removing users who leave the organization
• Ensuring accurate billing information is kept current

Corporate Goody Points earned by employees on corporate bookings are governed by the corporate account agreement and may be directed to the company's designated nonprofit partner.

9. Referral & Affiliate Program

• You may refer new users to LetsGoSave using your unique referral code. Referral rewards are issued only when the referred user completes their first eligible booking.
• Referral codes may not be posted on coupon sites, used to refer yourself, or abused to generate artificial referral activity. Abuse will result in forfeiture of rewards and account suspension.
• Affiliate commissions are calculated based on confirmed, non-cancelled bookings and are subject to the terms of your affiliate agreement.

10. Intellectual Property

All content on the Platform — including text, images, logos, icons, graphics, UI design, and software — is the property of LetsGoSave, Inc. or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.

You may not reproduce, modify, distribute, display, sell, or create derivative works from any Platform content without our prior written permission. You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial travel booking purposes.

11. Third-Party Services

Our Platform integrates with and may link to third-party services including travel suppliers, payment processors, map providers, and social platforms. We are not responsible for the content, accuracy, privacy practices, or availability of these external services. Your use of any third-party service is subject to that service's own terms and privacy policy.

12. User Content

If you submit reviews, photos, or other content to the Platform, you grant LetsGoSave a non-exclusive, royalty-free, worldwide, perpetual license to use, display, reproduce, and distribute that content in connection with our services. You represent that you own or have the right to submit such content and that it does not violate any third-party rights or laws.

We reserve the right to remove any content that violates these Terms or that we deem, in our sole discretion, to be inappropriate, misleading, or harmful.

13. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED AVAILABILITY.

We do not warrant that: (a) the Platform will be error-free or uninterrupted; (b) travel pricing or availability information will be accurate or up-to-date; (c) results obtained from using the Platform will be accurate or reliable; or (d) any errors in the Platform will be corrected.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LETSGOSAVE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE PLATFORM, INCLUDING LOSS OF PROFITS, LOSS OF DATA, PERSONAL INJURY, OR PROPERTY DAMAGE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO LETSGOSAVE IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

15. Indemnification

You agree to defend, indemnify, and hold harmless LetsGoSave, Inc. and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from: (a) your violation of these Terms; (b) your use of the Platform; (c) your violation of any applicable law; or (d) your violation of any third-party rights.

16. Dispute Resolution & Arbitration

Informal Resolution First: Before filing any formal claim, you agree to contact us at legal@letsgosave.com and attempt to resolve the dispute informally. We will try to resolve your concern within 30 days.

Binding Arbitration: If informal resolution fails, you and LetsGoSave agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Platform will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitration will be conducted in New York, NY, or remotely if both parties agree.

Class Action Waiver: YOU AND LETSGOSAVE AGREE THAT EACH MAY ONLY BRING CLAIMS AGAINST THE OTHER IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

Exceptions: Either party may bring an individual claim in small claims court. Either party may seek emergency injunctive relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration.

Opt-Out: You may opt out of arbitration by sending written notice to legal@letsgosave.com within 30 days of first accepting these Terms. If you opt out, disputes will be resolved in court as described in Section 17.

17. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. For disputes not subject to arbitration, you consent to exclusive jurisdiction in the state and federal courts located in New York County, New York.

18. Modifications to Terms

We may modify these Terms at any time by posting the revised version on our Platform with an updated "Last Updated" date. We will provide advance notice of material changes via email. Your continued use of the Platform after the effective date of the revised Terms constitutes your acceptance. If you do not agree to the modified Terms, you must stop using the Platform.

19. Severability & Waiver

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect. Our failure to enforce any provision of these Terms shall not constitute a waiver of our right to enforce it in the future.
